$125,000 civil penalty plus $75,000 supplemental environmental project payment

MDE's 2022 enforcement announcement states that a settlement of alleged air-pollution violations required PSEG Keys Energy Center LLC to pay a $125,000 civil penalty and provide $75,000 to a Patuxent Riverkeeper-led environmental program. Allegations included particulate exceedances in late September through early December 2019, a carbon-monoxide exceedance during a July 2020 startup, and failure to perform a required boiler-optimization analysis. MDE stated that corrective physical and operational changes had been made.

The Corps public notice described permanent wetland fill for the plant and access culvert, resulting in permanent impacts to approximately 1.91 acres of palustrine emergent (PEM) wetland and 0.02 acres of palustrine forested nontidal (PFO) wetlands.
