Austin City Council records reported that existing bond funds were projected to run out before completion and that approximately $31 million in additional funding was required for Fayette. The records also identified revenue-bond authority and Fayette construction expenditures within the city electric-utility capital program.

Sargent & Lundy undertook an LCRA study to improve Unit 3's flue-gas-desulfurization performance and reliability, including a target of at least 95.5% sulfur-dioxide removal without bypass.
The project underwent a major overhaul, including installation of new scrubbers and other upgrades intended to comply with federal environmental requirements.
An Austin memorandum discussed a possible sale of Austin Energy's interest. The participation agreement gave LCRA a right of first refusal, imposed evaluation and closing periods, prohibited partitioning of the facilities, and could have required defeasance of project-related debt if sold to a nongovernmental buyer.
Austin's Joint Sustainability Committee approved a recommendation to establish a debt-defeasance fund and negotiate with LCRA to retire Austin Energy's portion by 2023. The recommendation cited $143.3 million of Fayette-linked debt expected to remain at the end of 2022 and potentially $75 million of additional interest.
Austin Energy reported that the participation agreement contained no retirement or exit mechanism other than a sale, and that LCRA's cooperation was essential. Approximately $160 million of debt was described as outstanding at that time.
Austin City Council approved an emissions-reduction plan calling for Austin Energy to shut down its portion of the Fayette project by the end of 2022.
Austin Energy did not achieve a viable and affordable agreement with LCRA to exit its share by the end of 2022. The project therefore continued operating rather than undergoing the proposed partial retirement.
